PPSIG Annual Meeting: Compliance Training for Physical Therapy Practices

Speakers: John Wallace PT, OCS and Mary Daulong PT, CHC, CHP 

John Wallace has over 30 years of experience in orthopedic physical therapy and cardiac rehabilitation in a variety of settings including acute hospital, acute rehab, home health care, skilled nursing, subacute care and outpatient orthopedic and sports medicine. He currently serves as President and CEO of BMS Practice Solutions, a rehabilitation technology and services company specializing in practice and patient management web-based software solutions, rehab revenue cycle management and Medicare compliance. He graduated from the USC Division of Biokinesiology and Physical Therapy in 1980. From 1983 to 1997, he owned and operated Peachwood Physical Therapy Corporation in Glendora, California, a large outpatient sports and spine center serving the eastern San Gabriel Valley. He left his practice in 1997 to help launch Team Spinnaker which later became WorkWell Systems and BMS Practice Solutions.

He is a former member of the APTA Board of Directors and served as a Trustee of the Foundation for Physical Therapy and Finance Officer of the California Physical Therapy Association as well as serving on many Chapter task forces and committees. He is the past Chairman of the California Chapter of the Private Practice Special Interest Group. In addition, he is a member of several major professional sports medicine, physical therapy and orthopedic organizations

Mary Daulong PT, CHC, CHP: For over two decades, Mary, owner of Business & Clinical Management Services, Inc. has skillfully guided private practitioners and rehabilitation billing companies through the maze of healthcare challenges due to its constant regulatory change. Her national reputation, resourcefulness and comprehensive knowledge supported by compliance credentials are what make her solutions-based approach so valuable.

Mary has specialized in healthcare operations, regulatory compliance, payment and healthcare policy and legislation throughout a career that includes self employment as a private practitioner and senior and mid-management employment in diverse settings. She holds a Bachelors degree from the University of Texas Medical Branch, SAHS, has masters-level business management education and has well over thirteen hundred (1300) hours of postgraduate education in healthcare and health care-related matters. She is the first physical therapist to become certified in healthcare compliance and is an active member of the Healthcare Compliance Association. She also is credentialed, by the HIPAA Academy as a HIPAA Privacy and Security Professional.

Ms. Daulong has owned and managed Business & Clinical Management Services, Inc. since 1985. Its initial function was to provide management services for private physical therapy practices. Following the sale of her practice in 1996, she focused exclusively on healthcare consultation for small to medium-large sized private practices and billing companies.

Over the last several years, Mary has honed her expertise in healthcare regulation with specific concentration on OIG Guidances, Medicare payment and coverage regulations, OSHA, ADA, Department of Labor, HIPAA/HITECH and professional practice regulatory compliance and operational integration.

Mary has created functional educational tools, audit instruments and monitoring techniques that have lent themselves to ‘train-the-trainer’ type products. She has been personally engaged in most operations required of rehabilitation and billing practices and, as a value-added component, enhances that with an oversight expertise that is delivered via her customized compliance plan development and management services.

Mary has been recognized by her profession and community and has regularly been billed as the ‘featured’ speaker in both national and state venues. She has been honored by academic institutions, state agencies, professional, community and civic associations as well as by her peers. She has and continues to be an active volunteer in her professional associations.

Description: Physical Therapists are typically excellent clinicians and their passion is with patient care.  Running the business of Physical Therapy can be challenging, but FUN!  There are a few components that we have not been trained to do and are not so fun.  Some of these components are Human Resources, Accounting, Legal Review and last but not least, COMPLIANCE.

Even though compliance is not so fun practitioners make a reasonable attempt to comply with all regulatory requirements, but are you?  Do you know what you don’t know?

Examples: Illinois-based Center for Children’s Digestive Health (CCDH) agreed to a $31,000 OCR HIPAA settlement in April 2017 after it was found to have not had a proper (Business Associate Agreements) BAA in place.

An OCR investigation found that CCDH did not have a BAA with FileFax, Inc. Records and that the PHI of at least 10,728 individuals was disclosed to FileFax “when CCDH transferred the PHI to Filefax without obtaining Filefax’s satisfactory assurance.”

OCR stated that CCDH must “develop, maintain, and revise, as necessary, its written policies and procedures to comply with the Federal standards that govern the privacy and security of individually identifiable health information.”

Similarly, Care New England Health System (CNE) agreed to a $400,000 HIPAA settlement in September 2016 for not having a BAA in place. OCR determined that Woman & Infants Hospital of Rhode Island (WIH), a CNE covered entity, did not have an updated BAA in place when unencrypted backup tapes with patient information were lost in 2015.
The need for updated safeguards that account for new technologies was also highlighted in the April 2017 settlement with Pennsylvania-based CardioNet. CardioNet agreed to a $2.5 million settlement after it had reportedly did not have a sufficient risk analysis and risk management processes in place when a laptop containing ePHI was stolen. 

  • Our health care system is complex. Ensuring compliance with federal laws and regulations is necessary to avoid fraud, abuse, and waste and to eliminate improper payments. Practices that embrace compliance principles in their practice culture can help to prevent problems from occurring in the future, speed and optimize payment of claims, reduce billing mistakes, mitigate the risk of an audit, and avoid conflicts with antikickback and self-referral laws
  • Physical therapy practices have been under scrutiny through such things as:
    • Claims-Based Functional Outcome Measures
    • Increased number and type of physical therapy documentation audits by insurance providers
    • Medicare Audits
    • HIPAA violations
  • Reporting requirements for PTs in private practice are changing under the Quality Payment Program—specifically through the Merit-based Incentive Payment System (MIPS) and advanced alternative payment models (APMs).
